Intellectual Property
Trident’s seasoned experts and professionals have extensive experience in valuing a wide variety of intellectual property assets, including patents, copyrights, goodwill, workforce, trademarks, trade names, and trade secrets. Trident’s economists, drawing on a thorough understanding of how value is generated, have valued intellectual property in connection with transfer pricing documentation, transfer pricing litigation, damages analysis with respect to infringement and misappropriation-of-trade-secrets litigation, and valuation for tax purposes.
In a recent case, Dr. Shapiro was engaged by counsel for a Fortune 500 bank to provide expert witness services in a case alleging misappropriation of intellectual property. Dr. Shapiro assessed the economic validity of the damage claim, demonstrated that the alleged misappropriation was inconsequential (for example, due to the ease by which the technology could be substituted for), and assisted counsel in their deposition and trial examination of plaintiff's witnesses. In April 2006, after a jury trial, verdict was entered for the bank.
